Considerations
EmPRO encourages the reporting of an incident that may give rise to a future medical malpractice lawsuit such as an adverse outcome in treatment or the request for records by an attorney or disciplinary or regulatory authority.
Summons/Subpoenas
The service of any legal papers in a medical malpractice action requires prompt notice to EmPRO in order to properly protect your interests.
- A Summons is served to initiate the commencement of an action (lawsuit).
- A Subpoena is issued by a Court to require a witness to produce records and/or testify in a medical malpractice action.
Both of the above should be reported.
Letters Asserting a Claim
A patient or their representative may make a written claim, prior to or in place of a lawsuit, for monetary damages. This type of asserted claim is treated similarly to a lawsuit and should be reported.
Administrative Actions
EmPRO provides defense coverage to certain insureds who receive an investigatory letter from a state licensing agency (i.e., the Office of Professional Medical Conduct and the Office of Professional Discipline). This type of letter should be reported.
Potential Incidents, Adverse Outcomes, and Related Record Requests
If you would like to report a potential medical malpractice incident or a request for records, please complete the appropriate Incident Report Form and forward the completed form to EmPRO’s Claim Department via mail, email, or fax.
Contemporaneous documentation is key. Do not alter your records in any manner after you become aware of a potential incident, adverse outcome or receive a request for records.
Contact EmPRO’s Claim Department before releasing any records or information to a third-party.
Limit your communication to your claim specialist and defense counsel. Do not contact or respond to the patient or the patient’s attorney.
